Separation Agreements

In some cases the parties can come to an agreement on all of the terms of the separation and divorce. They might agree on (among other things):

  • Who shall have primary custody of the children
  • Visitation schedule
  • Amount of child support
  • Amount and duration of alimony
  • Division of property

In these cases, it can be very important to properly memorialize the agreement because, let's face it, sometimes people change their minds. Also, it can be important to incorporate the Separation Agreement into the Judgment of Absolute Divorce so that the Court will have the power to enforce the Separation Agreement through contempt. This process may not seem important on the front end, when everybody is happy and agreeable, but it can be profoundly important if the other party ever decides to stop abiding by the agreement. This can be of particular importance when dealing with child custody, visitation and support.
