Children & Child Custody
Often the impact of a divorce upon the children can be the most emotionally charged and difficult part of a separation and divorce. Who has primary legal and physical custody of the children can be a point of contention. Visitation schedules must be worked out between the mother and father. How these issues are resolved can have a huge impact on the amounts of child support which must be paid.
Child Custody
Sometimes this one is easy - sometimes it's not. In some cases, one spouse works long hours or travels and does not have the means to care for the children on a full-time basis. In other cases, there are allegations of child abuse or that a parent is unfit. In those cases, it is common for the Court to appoint the Council for Children's Rights (www.cfcrights.org) to advocate for the child and serve as a Guardian ad Litem.
Child Support
In North Carolina, child support is primarily determined by formula. The North Carolina General Statutes provide for a determination of child support payments based upon custody, visitation, work related child care expenses, insurance payments, extraordinary expenses, and the incomes of the parties.
