The Fifth Amendment to the United States Constitution protects each of us against self-incrimination. You are not required to do anything that would incriminate you at a later time in court.

So the answer is, if you feel that the results of the test may help the state of North Carolina in convicting you of DWI, you do not have to do any test. And the police officer can’t make you do those tests
